Website Terms and Conditions
These terms and conditions apply to visitors to the website www.camtechcams.com.au (“the Site”) (“Visitors”) and to customers who purchase goods through the Site (“Customers”). The term (“Users” “you” “your”) means both Visitors and Customers. The Site is owned by Camtech Australia Pty Ltd (ABN 039 056 808 934) (“Camtech Cams” us” “our” “we”). These terms and conditions may be amended from time to time without prior notice to Users. Users should review this page when visiting the Site because your continued use of the Site will indicate your acceptance of any amendments that have been made to these terms and conditions.
2. Conditions of purchase
To purchase products through the Site Users must:
- Be capable to form legally binding contracts; and
- Accept these terms and conditions.
If you do not satisfy the above requirements you must immediately cease using the Site. If you make a purchase through the Site on behalf of another person (including a business) you represent and warrant to Camtech Cams that you have the authority to bind that other person as a principal to these terms and conditions. Customers are not permitted to on-sell goods purchased from Camtech Cams and we reserve the right to refuse any order placed through the Site.

Customers will receive an email confirmation of your order and receipt of payment. We use our best endeavours to keep our website updated with stock availability. If we are unable to fill an order, products can be placed on back-order and the Customer will be notified of the anticipated time for delivery. If a product is not available on the Site, Customers can arrange for a back order through our contact form.
We deliver to all locations within Australia. Deliveries are made on ordinary business days (excluding public holidays as applicable to the Sydney region). Estimated delivery times are between 1 and 5 days from the date of placing your order.We provide tracking orders upon request. Customers are responsible for ensuring that the correct delivery address is provided and may incur additional freight costs where an address is incorrect. We use third party providers to deliver goods and freight charges vary per order and location. Freight charges exclude insurance and Customers should obtain their own insurance for the products during freight. Deliveries will not be left at a delivery address unattended, without the Customer’s authority. If the Customer authorises Camtech Cams to leave goods unattended, you do so at your own risk, and Camtech Cams is not responsible for the goods, once they have been left at an unattended address.
7. Changing an Order
Orders can be added to at any time through our Site, subject to additional freight charges. We cannot guarantee that additional products ordered will be delivered at the same time as the original order. Orders cannot be changed once sent for delivery, however Customers can return the products at your own cost within seven days of receipt if the following conditions are satisfied:
- the product has not been used,
- the packaging is intact;
- the product is in the same condition as when sent by Camtech Cams; and
- the Customer has given prior notice toCamtech Cams of the product return.
Freight costs will not be refunded to the customer unless required by the Australian Consumer Law. Changes to custom orders may not be able to be facilitated once work has commenced in which case the change request will be treated as a cancellation of the original order. If a custom order can be changed, Camtech Cams will notify the Customer of any additional costs that arise from the change. The Customer will be required to pay the additional costs upfront prior to the changes being made.
To cancel an order Customers must contact our office, by telephone or using the website inquiry form. If an order is cancelled after the product has been dispatched for delivery, the Customer should follow the process set out above for ‘Changing an Order’. Where a custom order is cancelled, the Customer is required to pay all costs incurred by Camtech Cams in fulfilling the order (including but not limiting to purchase products, materials and labour).
Refunds are not provided for a change of mind. Customers are responsible for checking product specifications prior to making a purchase.Camtech Cams will process refund requests in accordance with its obligations under the Australian Consumer Law. Refund requests should be made by contacting our office or through our website inquiry form. The Customer agrees to comply with the reasonable requests of Camtech Cams to facilitate a refund request including providing photographs of the products upon request and returning the product. Refunds are not provided where there is a default with the packaging only.
Refunds will not be provided when the product has been subject to:
- incorrect installation;
- being used in a way that is not for its intended purpose;
- negligence of the Customer;
- damage caused by the Customer or a third party;
- environmental damage;
- non-compliance with the product information and fitting instructions;
- lack of maintenance as required.
10. Force Majeure
Camtech Cams is not responsible for any delay, or failure to deliver the products arising out of circumstances beyond our reasonable control, including but not limited to weather, strikes or labour difficulty, fire, flood, acts or omissions of third parties, inability to obtain necessary materials or equipment, accidents, breakdown of machinery or the failure of third parties to perform services.
11. This Site is provided “as is”
Access to this Site is granted by Camtech Cams an “as is” basis. Whilst we make every reasonable effort to ensure that the information on the Site is up to date and complete, we make no representation or warranty as to the accuracy or reliability of the Site content. Variations of product colouring may occur as screen resolutions of individual Users vary which impact upon the colour and display of images. For this reason, Camtech Cams does not warrant that the goods purchased will look the same as the images displayed on the Site.
We do not warrant that the functional aspects of the Site will be uninterrupted or error free or that the Site, its content or the server are free of viruses or other harmful components. Camtech Cams does not guarantee against third party interference nor that the Site or its content will be compatible with third party software or hardware.
12. Acceptable Use of Site
Users agree to use the Website in accordance with this Agreement:
- in good faith;
- in a way to not bring disrepute or cause reputational or other damage to Camtech Cams.
Usersmust not use the Site in a way that:
- is fraudulent;
- invasive of another’s privacy;
- infringes the intellectual or other proprietary interests of third parties;
- contains viruses or other harmful components that are designed to interrupt, destroy, change or limit the functionality of the Site or any other computer software, hardware or other electronic equipment;
- uses technology or other unauthorised means to access the Site;
- uses or launches any automated systemto access the Site;
- gains or attempts to gain unauthorised access to the Site including the networks or user accounts;
- attempts to or engage in conduct that damages, disables, overburdens, or impairs the Website, servers or networks;
- or encourages or incites any other person to engage in any of the above behaviour;
- frames or utilize framing techniques to enclose the Site or any portion of the Site;
- modifies, reverse engineers or create any derivative works based upon the Site or any of its content;
- collects account information for the benefit of yourself or another party;
- uses any meta tags or any other hidden text utilizing any of the content on the Site;
- uses software robots, spiders, crawlers, or similar data gathering and extraction tools, or take any other action that may impose an unreasonable burden or load on our infrastructure or server;
- includes downloading any image or content and passing it off as your own, or
- encourages any other User to engage in the above.
13. Intellectual Property Rights
Camtech Camsretains all ownership rights over all intellectual property (registered or unregistered) available on the Site including, but not limited to, audio-visual effects, themes, stories, dialog, settings, artwork, sounds effects, musical works, and moral rights. Camtech Cams claims copyright over all content on the Site or is using the content on the Website with the consent of the copyright owners, unless otherwise indicated.
14. License to Users
Camtech Cams grants Users access to the Site through this license. Camtech Cams grants Users the non-exclusive, non-transferable, limited right to use the Site to view and purchase Camtech Cams’ products for personal use. This license commences upon the User first visiting the Site and continues until termination by Camtech Cams or the User. Camtech Cams has the discretion to terminate this license immediately and without notice if a User breaches this license andCamtech Camsreserves its right to take action against the User. All rights not specifically granted under this Agreement are reserved by Camtech Camsand, as applicable, its licensors. This licence excludes the right to republish, redistribute, transmit, sell, or license the Site or any of its content and excludes the right to make any use of the Site or any of its content other than for personal use.
15. Uploading content to the Site
By uploading content to the Site, the User grants Camtech Cams a non-exclusive, limited right to use the content for the sole purpose for which the User provides it to Camtech Cams.Users acknowledge that by making comments on the Site, theUser’s identityand comments made may be made publicly available on the Site, at the discretion of Camtech Cams. By uploading comments to the Site, the User authorises Camtech Cams to display the review to the public on the Site.When uploading content to the Site (including when opening an account) the User warrants and represents to Camtech Cams that the content is true and correct, and is not false or misleading in any way (including by omission).
16. Limited Liability
Without limiting the operation of the Australian Consumer Law, Camtech Camsexcludes all conditions, warranties, terms and guarantees otherwise implied by law. Users use the Site at your own risk and Camtech Camsis not liable for any misuse of the Site by a User. To the extent permitted by law Camtech Cams is not liable to pay for any indirect, economic, special or consequential loss or damage including but not limited to loss of revenue, profit, goodwill, business or claims made against it arising from a User’s use of the Site or Camtech Cams products.
Users agree to indemnify and keep Camtech Camsfully indemnified against all claims by any person whatsoever for injury, loss or damage sufferedin connection with the User’s use of theSitewhere the claim arises from the User’s breach of these terms and conditions.
18. Breaches of these terms and conditions
Camtech Cams reserves the right to take any of the following action if we reasonably suspect that a breach of this Agreement has occurred:
- issue a formal warning;
- suspend or prohibit access to the Site;
- block access to theSite;
- take legal action against you,
- suspend or delete your account, and
- report a matter to law enforcement.
If we suspend or prohibit or block your access to the Site, action taken by you to circumvent suspension or prohibition or blocking will be considered as a further breach of this agreement.
If any provision of this Agreement is invalid under any law the provision will be deleted from the Agreement to the extent of the invalidity and the remaining provisions will remain in full force and effect. This Agreement shall be governed by and construed in accordance with the laws of New South Wales and Australia and any claim arising out of this Agreement will be determined in New South Wales.
